Terms of Service

    Last updated: October 15, 2026

These Terms of Service ("Terms") govern your use of the NearField platform operated by NearField ("we," "our," or "us"). By creating an account or using our services, you agree to these Terms.

    1. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. One person or organization may maintain one account, and each account can have one trial.

    2. The Service

NearField provides a platform to create digital Experiences (mobile-first content pages) and connect them to physical NearField Markers, which carry an NFC chip and a QR code. While you build, you can use every block and Action included in the Growth plan, across up to 3 Experiences. Without a paid plan, an account can keep one Experience published and place up to 3 Markers. Our pricing page lists what each plan includes. Paid plans add more published Experiences, Marker placements, blocks, Actions and analytics.

    3. Plans, Trials and Automatic Renewal

This section explains when you are charged and how to stop it. Please read it before you publish an Experience or order Markers.

    3.1 Plans

Paid plans are billed monthly or annually, in US dollars, at the prices on our pricing page, plus any sales tax that applies. Plans bought on our website are billed by Stripe. Plans bought in the NearField iPhone app are billed by Apple under Apple's terms, start when you buy them, and are managed and cancelled in your Apple ID settings. Starter and Growth bought there may begin with Apple's free trial, which Apple gives once per Apple ID: Apple charges the plan's price when that trial ends unless you cancel at least 24 hours before. Buying a plan in the app during your NearField trial replaces that trial with the plan.

    3.2 The 14-day trial

Building is free, and no card is needed to build. Your 14-day trial starts the first time one of these happens:

    • you activate a Marker, with its PIN, on a published Experience; or
    • what you have published needs a paid plan: more than one published Experience, more than 3 Markers placed, or a block or Action that only a paid plan includes.

During the trial, nothing is charged and your visitors see every block and Action included in the Growth plan. Unpublished drafts never count toward a plan. Each account can have one trial. If you buy a plan in the iPhone app, that purchase uses up the account's trial.

    3.3 Your saved card

If you are not on a paid plan when you order Markers, checkout asks you to agree to save the card you pay with for your NearField plan, with this wording: "We'll save this card for your NearField plan. Your 14-day trial starts when you activate a Marker or publish your page. On day 14 we'll start the plan your live pages need (from $19/month), and we'll email you 3 days before. Change or cancel anytime in your dashboard." Stripe stores the card. We keep only its brand and last four digits. If your trial starts without a saved card, we ask you to add one before it ends.

3.4 What happens at the end of the trial

Unless you cancel first, at the end of your trial we start the lowest-priced plan that covers what is published at that moment (the blocks and Actions on your published Experiences, how many Experiences are published, and how many Markers are placed), and we charge that plan's price to your saved card. The lowest paid plan is currently $19 a month. If you chose Starter or Growth during your trial, we start that plan instead, as long as it covers how many Experiences are published and how many Markers are placed. If everything published fits the Free plan, nothing is charged. We never start the Enterprise plan automatically; if that is what your account needs, we contact you instead.

3.5 The reminder before any charge

On day 11 of your trial, 3 days before it ends, we email you the plan we will start, its price, why your account needs it, and links to change or cancel. We never charge for a plan that starts from a trial until at least 3 days after that email is sent. If it goes out late, the charge waits.

    3.6 Automatic renewal

A plan, whether it started from a trial or you bought it directly, renews automatically at the end of each billing period (monthly, or yearly for annual billing) and is charged to your saved card at the then-current price, until you cancel. We will email you before a price change applies to your plan.

    3.7 How to cancel

You can cancel online at any time, with no call needed:

    • During your trial: choose "Don't start a plan" on the Your plan page in your dashboard (getnearfield.com/field/plan), or use the "Don't start a plan" link in the reminder email. Nothing is charged.
    • After a plan starts: choose Manage Billing on the Account page in your dashboard, which opens our billing portal. Cancellation takes effect at the end of the current billing period, and you keep the plan until then.
    • Or emailhello@getnearfield.comand we will cancel it for you.

No prorated refunds are issued for partial billing periods.

    3.8 If no plan starts

If you cancel, have no saved card, or a payment does not go through, your published Experiences stay published and your Markers keep working. Blocks and Actions that need a paid plan are hidden from visitors until a plan that includes them is active. Publishing more Experiences or placing more Markers than your plan allows needs a plan that covers them.

    4. Hardware Orders

NearField Markers are physical products shipped to your address. Hardware purchases are non-refundable once shipped. If a Marker does not work, we replace it. Up to 3 Markers can be placed without a paid plan, and activating a Marker on a published Experience starts your trial (section 3.2). The features available on each plan are subject to change.

    5. Your Content

You retain ownership of all content you create on NearField. By publishing an Experience, you grant us a limited license to host and display that content to visitors who access it via your Markers or direct links. You are responsible for ensuring your content does not violate any laws or third-party rights.

    6. Acceptable Use

You agree not to use NearField to:

    • Distribute illegal, harmful, or misleading content
    • Impersonate another person or organization
    • Interfere with the operation of the platform
    • Attempt to access accounts or data belonging to others
    • Collect personal data from children under 13 without verifiable parental consent
    • Use captured visitor data outside the purpose disclosed in your own privacy notice

    7. Visitor Data & Your Responsibilities as Controller

When your Experience uses capture blocks (Email, Phone, Name, Custom Input, Geo Check-in, Donation, Quick Choice, Rating), you are the data controller for the information visitors enter and NearField processes that information on your behalf. You agree to:

    • Post your own privacy notice that explains what you collect and why, and link to it from your physical or digital touchpoints where appropriate.
    • Only use captured visitor data for the purpose disclosed to visitors at the point of capture.
    • Honour visitor requests to access, correct, or delete their data within 30 days, with NearField's assistance via support if needed.
    • Not enrich, resell, or share visitor data with third parties unless visitors have separately consented.
    • Respect visitor consent choices. NearField will block writes when consent has not been granted, and you may not attempt to circumvent these gates.

NearField provides standard processor terms by reference in this section. Where required by law (e.g. EU/UK GDPR Art. 28), additional written terms can be provided on request.

    8. Intellectual Property

The NearField name, logo, and platform design are the property of NearField. You may not use our trademarks without written permission.

    9. Limitation of Liability

NearField is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

    10. Downgrade and Termination

If you downgrade, cancel, or your plan ends, your published Experiences stay published and your Markers keep working. Blocks and Actions your plan no longer includes are hidden from visitors, and your content is preserved, so changing plans brings them back. We reserve the right to suspend or terminate accounts that violate these Terms.

    11. Sponsor+ Program

Organizations participating in the Sponsor+ program receive Markers funded by a local business sponsor. Sponsor visibility on Experiences requires your approval. Program eligibility and terms are determined at our discretion.

    12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the service after changes constitutes acceptance.

    13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Pinellas County, Florida.
